Type of personal information we collect
We currently collect personal information which include
· Individual names
· Driving licence numbers
· Photographic images
· Contact details such as email addresses, postal addresses, telephone numbers.
· Tachograph Data
How we get the personal information and why we have it.
Most of the personal information we process is provided to us directly by you for one of the following reasons:
· To record driver CPC training or any other training records
· To submit information to awarding bodies for the gain of a qualification this may be through a third party.
· To communicate the needs of our business for the purpose of entering into a contract.
· To submit evidence to the DVSA and Traffic Commissioners when conducting audits on behalf of Goods Vehicle & Passenger Vehicle operators.
· Analysis tachograph data on the behalf of a Goods vehicle or Passenger Vehicle operators.
· We also receive personal information indirectly when conducting compliance audits to establish true records are held and required as evidence to support a transport compliance audit. This information would be supplied by a Road Haulage or Passenger Transport Vehicle operator or employer of a business of whom we are contracted.
Your personal information is used in the following way
· Upload training hours to the DVSA Recording and Evidencing Data base for the recording of driver CPC training hours.
· To forward to an awarding organisation to submit evidence that a qualification has been achieved and a certificate or licence will be required holding personal information.
· On occasions where evidence is required to support a Public Inquiry or compliance audit instructed by an operator of Goods Vehicles or Passenger Vehicles, we will send this to the Office of the Traffic Commissioner.
· To enter into a contact with you or your business for the needs of our business to ensure the planning and operation of any contract you have entered into with our company.
· Tachograph data will be analysed that may include personal data to ensure drivers of Goods Vehicles and Passenger Vehicles are compliant with both domestic and EU regulations.
We may share this information with the following organisations
· National Logistics Training Consortium for the processing of driver CPC training
· Driver & Vehicle Standards Agency to upload driver CPC training hours
· Blyth Automotive Solutions Ltd for the purpose of processing IMI awards and qualifications namely Institute of Road Transport Engineers
· Convey Technology Limited for the purpose of tachograph data analysis
· Office of the Traffic Commissioner for the purpose of auditing evidence or Public Inquiry.
· Goods Vehicle and Passenger Vehicle operators.
· When new organisations or individuals become engaged in sharing information, we will add them to this policy.
Under the UK General Data Protection Regulation (UK GDPR), the lawful bases we rely on for processing this information are:
(a) Your consent. You are able to remove your consent at any time. You can do this by contacting Prestige Transport Compliance & Training Ltd on the above details.
(b) We have a contractual obligation.
(c) We have a legal obligation.
(d) We need it to perform a public task.
(f) We have a legitimate interest.
How we store your personal information
Your information is securely stored by an electronic means namely computer hard drive. We do not hold hard copy data, other than in the event of providing data for the Office of the Traffic which will be temporarily in our possession will conducting compliance audits on behalf of Goods Vehicle and Passenger Vehicle operators.
Tachograph Data is held by Convey Technology Limited on secure servers. Please see their own privacy policy or contact us for more information.
Periods Data is Kept
· We keep driving licence information and names up to 6 years for the purpose driver CPC training
· Information for the processing of other qualifications is kept for 6 months following the date of its processing shown on training records.
· Information gathered for a compliance audit or Public Inquiry is kept for no more than 6 months following the data of submission to the DVSA or Office of the Traffic Commissioner.
· Tachograph Data is held for a period of at 24 months, by the software supplier currently Convey Technology Limited.
· Business emails and customer a customer database is kept indefinitely or until such time Prestige Transport Compliance & Training no longer engage with that company or individual.
We will then dispose your information by deleting the data from the hard drive.
Hard copy data is returned to the supplier normally within 2 weeks of it being in possession.
Information that we access via portals for the purpose of tachograph analysis will be managed by the software supplier namely Convey Technology Limited.
Your data protection rights
· Under data protection law, you have rights including:
· Your right of access - You have the right to ask us for copies of your personal information.
· Your right to rectification - You have the right to ask us to rectify personal information you think is inaccurate.
· You also have the right to ask us to complete information you think is incomplete.
· Your right to erasure - You have the right to ask us to erase your personal information in certain circumstances.
· Your right to restriction of processing - You have the right to ask us to restrict the processing of your personal information in certain circumstances.
· Your right to object to processing - You have the right to object to the processing of your personal information in certain circumstances.
· Your right to data portability - You have the right to ask that we transfer the personal information you gave us to another organisation, or to you, in certain circumstances.
· You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.
